Mmm ,all the legal things from Aus give me bad vibes (i think they still keep the laws from the 19 century) ... shit ,we welcome Westy in Argentina when he get out ,we didn't have stupid laws ,even the incest is legal ,and the age of consent is between 13 to 16 years by law ... ah ,the fiction is fiction ,nothing ilegal ,like Japan.

Which are the next 2 sentences, personally your view does not matter, unless you were the judge.;)

Why are you trying to defend someone that hard who has the actual real stuff in quite extreme ways? That guy had material of very young children who went through horrible things. REAL children. Und you are like "Ackchually the main rason for conviction was the game". You can expect that the penalty for having the actual stuff would probably not have been much lower if he did not make the game in the first place. In fact,the game is the reason why they found him, so I am not unhappy in this case that they have that strict laws for fictional stuff if it helped to get someone who was as depraved as him.

Sorry, I'm stepping in on this one. Normally, I'd agree with you completely. But this is Australia. I also talk with some of Westy's close friends. You can bring up that they couldn't have known or whatever. But this is a country that tries to make anything they disagree with look far worse than it actually is. Which also instill fear to those who know this. We don't believe Westy is dealing in actual real ** because of the type of country he's in. Don't believe everything these so-called medias tell you and go by your own hunch.

Still uncertain about that last one with the self-harm bit. I can only think of 2 things; One, this is actually a neighbor that hates him because he wanted security camera or two, this never happened and the media included that in.

I just found this story and states here:

"The majority were video and pictures from his abuse game, although Judge Mullaly said police found 557 files depicting real children and videos taken of three women through their bedroom windows."

"He also pleaded guilty to possessing material of real children being sexually abused and spying on and filming three women in their own homes."

Surely there would be a record of what he pleaded guilty to? If it didn't happen why did he plead guilty to it?

For court, depending on where you live, if you do not plead guilty to anything even if you're completely innocent, can receive the maximum sentence. So this could be either a lawyer telling him to plead it or he was only given that option with no way of backing out of it. The court system is basically legalized blackmail when you think about it. I think I explained this somewhere in here but it's very similar to what I've gone through, just with a completely different charge altogether.

Well I got arrested 12 years ago for ABH, there were to two witness statements claiming I was to blame, I went to court pleading not guilty. It was a case of self defence, when I got to court my lawyer told me that one of the witnesses wasn't going to appear. Then during the trial the other witness admitted that they did see all of the incident and I then demonstrated all the moves I used on the attacker to defend myself and I was found not guilty by the judge.

Also back in the 90's I once did jury service and was on three separate cases, on the last case four guys got arrested and three of them pleaded guilty and one pleaded not guilty. We ended up finding him guilty because his story was so unbelievable, I am surprised he even wanted to go to trial.

I'm not defending anyone. Why should I defend, or for that matter, attack someone?

There are many people who get convicted for C.P and that's fair enough. It's illegal, it's hurtful, it's just plain evil. Most of such cases never make the news.
There are also many people spying on their neighbors. This is bad and an invasion of privacy. I never heard about anybody going to prison for that though. Unless it's filming minors in a communal showerroom or something.

The game angle is what makes this case interesting and important. And you can't deny the impact this case already had on the community.

Also, many of us did interact with Westy and (as far as you can tell by interacting with someone on a forum) found him a pretty nice guy.

Finally, what we are basing ourselves on are a few newsarticles and we (hopefully) all know how dependable those can be,

Yep, 577 images and videos of real children to be exact. On (Removed by automod), someone said "In the paperwork, it names several of the real csam vids with one being "Daisy's Destruction." So, you don't go searching the open web for this, Daisy's Destruction is a series where Australian Peter Scully and help by his two Filipina girlfriends, Carmen Ann Alvarez and Liezyl Margallo Castaña and others, tortured several girls from 18mo to 14yo. Scully during the series raped and murdered a 3yo on camera after making her dig her own grave and hung a 18mo like rack of meat at the butcher."

Not really feeling any sympathy for him if he had videos like that.
What the fuck...i hope this is not true...there is no punishment severe enough for someone who does something abhorrent like that...i am mortified by the thought someone does this to people, let alone children...

To the topic...the descriptions given by the judge and papers are very likely overblown for dramatic effect, given how the game is described by them. And saying the game "motivates people to abuse real children" is just utter nonsense. There has never been a study, showing if CSAM or 2D-3D art increases or decreases the chance for someone to act upon their impulses/fetish/whatever.

Westy shouldnt have had the real stuff to begin with, and he shouldnt have made the game while living in australia. 8 years is probably a good deal for him. Hope he gets treatment/therapy while imprisoned, i dont know the australian prison system.
 
Well, that sounds worse than I thought, but my God, one from Australia and one from Canada, literally two worst places on earth to do loli stuff. Another thing is if I earned almost 1 mil, I would get the fuck out from Australia and move somewhere where doing this stuff was legal. Still, if he went as far as this article claims then I kinda understand him not moving away because that stuff is not acceptable anywhere.

I have no reason to believe it's better than the U.S. system, with an emphasis on punishment, degradation and lifelong persecution rather than rehabilitation and therapy. They're reduced to numbers rather than names and treated like animals, and find getting a job after prison to be a near-impossibility, and people wonder why the system doesn't work. :rolleyes:

On the other hand, I don't think they have private, for-profit prison corporations there, which are a scourge on America, since their profit model requires packing as many prisoners into the smallest space as they can get away with and spending the least possible money on things like maintenance, food, competent staff and treatment, while forcing them to work for pennies an hour and charging ridiculous prices for commissary and phone privileges. :mad:

Correct, but when it comes to manga/anime/3D it typically does not incur severe penalties on a first offense. Even so, it's a max of 2yrs and $18K fine in the most extreme cases (and a boot out of the country if he doesn't have a visa). The other messed up crap he was doing was the driving force. Of course, getting a residence card isn't easy for Japan. They have some very strict rules and you cannot 'work' in Japan as a tourist as it breaks the rules too. I was basically just spitballing though. His behavior outside of the game precludes anything else IMO.

Australia has some private prisons. In the state of Victoria where he is there are 3 private holding roughly 40 % of Victoria`s prisoners and 11 state run prisons.
