They have been trying to make this illegal in the US, too. Some years back the Supreme Court said it's protected as long as it's not real people - but then there wasn't the big scare about AI - and the court has reversed other major decisions since then given the membership has changed...
 
Nah, not true. Firstly, it is not "policemans" who decide about arrests like that. Secondly, I was once called to police station regarding torrenting stuff (I was pretty green back then), they told me prosecutors decided to call me for hearing, they don't care and if I had something on my PC I had enough time to remove it already so they noted I was present, they didn't find any basis to proceed the case, case closed, you can go home. They didn't even ask me anything. Thirdly, and I am surprised I need to say again, EU is not a country, countries have their own laws and laws of a country are higher than laws of the EU. There are countries where laws don't say anything about art depiction and then it's grey area and there are countries that openly state every art is fine.

Torrenting is one thing.

Getting accused of C.P (artificial or not) or actual sexual abuse is something else completely.
And it doesn't matter who decides to arrest you for it, maybe it is an overzealous policeman who is grossly overstepping his authority, Maybe it's a prosecuter who wants to make a name for himself. It doesn't matter. It also doesn't matter if it actually holds up in court because the damage is already done. Just like in this case.

And, no, the EU isn't a country yet, but it does have regulations and those regulations do trump (heh!) national laws, because member states are obliged to put EU regulations into their national laws.

I hope so, but I'm pretty worried that "Must Register as a Sex Offender for Life" part will prevent Westy from continuing to develop the game even when he gets out of prison and when he gets out of prison, he's about 46 years old (max), will he still want to continue at that time or not.

I mean if what @BadJM said is true then "real children being abused" sounds pretty straightforward. I don't think any police in any country would make that claim if it was not REAL. Aside of that secretly filming 3 female neighbours... if someone does something like that then the rest is even more probable.

With how many times they threw shit out there, I have a hard time trusting what they say. I mean, they even called his collection "disturbing" which is just harmless shit. While I can't deny or otherwise due to not see any evident of their accusation, I would take this with a grain of salt if I were you.

He pled guilty to more than just making a game. His collection included real live kids some not even primary school age.

My post was just a joke, there is no way Westy will be able to continue PF once he has been released.;) The only chance of that happening is for him to emigrate to another country, where the game is considered legal.(y)

I found another article and it is confirmed that he had images of real children being abused so yea... Being arrested for the game is dumb but he deserves to go to prison for the real stuff. He also admitted to secretly filming 3 female neighbours.

For what it's worth, the game Proud Father never gave off that kind of dark, creepy vibe. Unlike some other games...

Legally it's clear though: by possessing that kind of stuff, he broke the law.

It does muddle the water about his conviction with regards to game development. Was the conviction mainly for the possession of these real pics and video's? Or was it mainly for developing a questionable game with computer generated graphics?

From some of the discussion I saw, the sentence was reduced from 14 years because he pled guilty and might have been reduced from an even higher number due to turning state's evidence on some others involved (maybe giving up his source for the videos?). I have a feeling that the reduction won't matter because I don't see him making it through his sentence, even being what it is.

I don't know how things are in Australia but I know that in a lot of countries people that are in prison for those types of crimes are usually separated from the rest of the inmates. But yea he will definitely not have a good time in there. As for the sentence, if @jaredh72 said is true then, even the 14 years wouldn't be enough in my opinion.

Absolutely reprehensible... Fantasy should stay that, just fantasy.

I don't care what people are into as long as others aren't being hurt. Storing and potentially sharing such content is disgusting.

Basically you need to beware in any so-called "free" country, except, perhaps, in the USA.

In countries where the rule-of-law is less established, you may be able to get away with more, assuming you keep the police on your good side, one way or another.
Hi from USA. This one is a tough one here. It's mostly state-by-State and intent based. I know in my state, as long as it for PERSONAL use and remains within the confines of your home, you can view and create lolicon(must be an obvious cartoon!). At least, that's what the law says. Note: that is not a direct quote because I don't have access to the resources I did at the time when I found that law. All around though, it's better to be safe than sorry and go with "No, you can't do it" in the USA. Hope this helps!
 
Mmm ,all the legal things from Aus give me bad vibes (i think they still keep the laws from the 19 century) ... shit ,we welcome Westy in Argentina when he get out ,we didn't have stupid laws ,even the incest is legal ,and the age of consent is between 13 to 16 years by law ... ah ,the fiction is fiction ,nothing ilegal ,like Japan.
