I think he changed his mind on that because he was worried it would negatively affect the court case. Maybe he will revisit that decision after everything is settled.

It is supposed to be but, as far as I know, no one who has tried to check on the case has found anything. Right now, it isn't clear whether it has been completely resolved. Also, if there is any sort of post-release control following the sentence, the appearance of the game being continued could be seen as a violation of that, even if he isn't doing it himself. He might be accused of passing it on to someone else, and when you have already been convicted, reasonable doubt isn't as much in your favor anymore.

As much as I would like to see the game finished, it's probably better to just let it die. It will just bring negative attention to the person finishing it. In my opinion it's not worth the risk.

After I read the incredibly bizarre law enforcement harangue about how horrible and evil the Dev was, it reminded me of how USA used to ban sodomy, and ban inter-racial marriages. Just today, I read an article about a woman in the USA who was being treated the same way, for bestiality. The people behind the arrest and prosecution could not even say exactly what she did with the dogs.... I mean, if she was fucking them with a stick (or something approaching rape), I could see the animal endangerment. Well, what do you want? Australia - the only way to leave there is by plane or by boat - not everyone can afford it.
That is, in essence, people there are locked up like sardines in a barrel - you can conduct various experiments on them and people cannot escape anywhere.
In America or Europe, this is a kind of freedom - you don't like the order in Belgium, for example - you run away to France. You get tired of Canada - you go to Mexico or even Brazil.

It all depends where the developer resides, if your in a country like Australia, where a drawing counts the same, or in this case with computer generated images, as real child pornography then the authorities might just set you as a example. While the real child predators can roam free, since for this statistics they are arresting the "bad" guys. I really hope someone outside such a country can complete this game.
