I agree with you about the unconscionable argument regarding the TOC's as protection. If anything it's extremely cynical and shows an utter disregard for consumer rights and expectations. That's why I hope it will go to trial as opposed to arbitration because I fear that if they are allowed to come to an agreement in secret there will be no way to 'hold their feet to the fire', as it were, in order to force them to change for the benefit of their consumers.
Kind of, off-topic but it's why I go into a cold sweat whenever I hear about companies pushing for loosening or abolishing what they claim are restrictive regualtions or even worse, going to a self-regulating system. These regulations and laws are there to protect the average citizen from the excesses that can occur with no oversight. As examples of what companies can and will do if they think they are above the law I would give DuPont regarding Teflon, or Perdue Pharma regarding Oxycontin or perhaps even more egregiously the entire global financial industry and the sub-prime mortgage crisis and its fallout.

I think it will be interesting if the more ubiquitous coverage of legal filings will actually change what arguments companies are willing to let their lawyers make. Disney's arguments against Gina Carano's lawsuit mostly relied on cases where an organization was allowed to discriminate against LGBT employees, an irony seized on by a lot of non-mainstream commentators with significant followings. More oral arguments are videotaped and available to the public as well, which is a lot more palatable than reading a hundred page legal document.

I actually had to check my DMs to see if I'd made a super secret gobbo list that I'd forgotten about. I had nBecause after the changes a month ot so back there's no real difference between public and Mem+, besides the games. The 7000+ page OG thread is in P4 and still gets some use. (I think..I haven't actually checked in a while. I like engaging with the plebs here.

Seriously... how do lawyers and such wear a full suit to work in 100degree heat?
I would heat stroke in 10 minutes. There is no way I could walk from my car to the courthouse and still look presentable. How do some people have such good temperature control? Is it like a superpower?

It really has to be a super power! I almost have a engineering degree and I know suits will be a thing… not looking forwards to that
