I actually understand the charges in that case. That is a really shitty thing to do to your classmates.

Although I would call it more bullying than **.

With regards to the other AI stuff, I think you need to look at the topic from the victims perspective. If there is no victim, how can there be a crime?

Legally speaking this brings up an interesting point... I think that, depending on the circumstances, creation or strict possession could be dismissed based on standing. Standing is the legal precedent that the person or entity bringing the charges has to have a reason to bring them... usually it's the damaged party. So if a person was scammed by a company I wouldn't be able to sue said company for the scam, it would have to be the person who was the victim of the scam. Some crimes, like murder, are taken up by the state because the injured party can't and there exists a reasonable danger to the public at large that the state is responsible for, thus has standing. If there isn't distribution or harassment involved (as there is in above cases) and there is no victim it might be argued that the state has no standing to prosecute the case.

I'm also no lawyer but:

Assume an underage person were to take a nude selfie. This would classify as c//p purely based on the material. It would be also absolutely stupid to charge him/her with possesion or creating it though.
If he were to send it privately to a girlfriend (which would be incredibly stupid but anyway) than also charging the girlfriend would be stupid.
If the girlfriend were to sell the pictures for bitcoin to a deepweb marketplace, THEN legal action would be warranted against both the "girlfriend" and website.
If the "girlfriend" were to send the pictures to the rest of the school to make fun of him, then the charge should be bullying (or an aggrevated form if that exists in the applicable legal system).

Agree with the last part but regarding the sexualization I suppose it does depend on the context...

Also, you might (in above example) argue that the person who took the selfie was sexualizing himself towards his "girlfriend". And therefore the "girlfriend" is not to blame for that.
Candid locker room photo's would be a different story altogether.

Its very much so for the best imo. Seath usually starts games fairly ok, but completely fumbles the last half of his/her games and the endings suck.

I dont see a world where it would have been done justice.

Thank you. The self censorship demanded here on this case "for the sake of the site" is frankly absurd. There is no legal danger with publicly discussing an open legal case. If you think that out of propriety, it's appropriate to forbid real names, fine. Given that the name is in the public domain, that seems unnecessary, but I'd accept that as a curtesy to Westy. Good.

Personally, I am not primarily interested in whether the game will be continued or not. That pales in comparison to the human aspect. I want to express my deep sympathy for Westy. For this horrible predicament that Australia's heinous laws have put him in. This is not "justice" in any true sense of the word.

I'm very glad that many of you are in countries where pictures are free for all. Some of us (like me who bounced from country to county in my later life) were not. I'm in a good place now... and speaking only for myself... I'm not going to fucking risk it for pixels. Right now, I'm safe when downloading Member+ games. The DAY it isn't... I'm going back to regular porn games, then regular porn, and finally no porn at all. I like keeping both hands, thanks. I have been checking the court lists etc. Nothing, no media reports. This is really weird. The only thing I can think of is that he may have been sentenced under an alias to protect his identity in Prison. I will keep looking and let you all know if I find out what has happened. Sorry guys

Absolutely insane to be sent to prison for pixels. I can understand ** due to the victims on video, but renders don't involve any humans at all.
