Proud Father (Off-Topic)

Going to prison because of a game is bullshit, but ever since I found out that he actually had content with real kids in his pc I stopped feeling bad for him.
I would say that most will agree with you. He crossed a line. Maybe when he gets sentenced we will find out why the pictures were never mentioned until recently. I get the feeling that there is more to this that we dont know yet.

I don't know if we will find out much more about it, it's not like this like a big story there. It's pretty hard to find information about it and most of the news articles about it are behind a paywall.

The only media that seems to be covering here is his local paper. Considering what he has done, the media silence is very unusual

I mean at the end of the day the main charge is for the game, most people will think it's gross but it's not like there are actual real life victims so they can't really squeeze much out of it.

The main charge is the picts of real life kids. The game and the money from it is secondary. In years to come they will say, he had hundreds of picts, oh and he was also making a game. Aussies are said to be, per head of population among the biggest pirates so most people in Australia could not care less about him breaking some censorship law. He has picts of real kids...He is a rockspider zero sympathy. Australia`s censorship laws are going to get worse regarding these games and they will use him to do it

Guys, regarding the pictures, we don't know what's going on.
It might be hardcore C P, it might be barely (il)legal nudes.
It's probably best not to speculate too much.

The media silence is a bit strange considering it is actually a fairly important case regarding freedom of expression.
Or perhaps our hobby is still way too niche for anyone to care.

It's either ** or not, no shades of gray.

It's either ** or not, no shades of gray.

A selfie of a cute, flirty 15 year old girl flashing her perky teen titties is not the same as video of a 5 year old being violently raped. But both are treated the same, or almost the same, by law enforcement and the public. It's completely asinine. So, for intelligent people, there are, or should be, shades of gray. But the law is made to satisfy stupid people who can't or won't think in nuanced ways.

No, intelligent people don't do stuff knowing it's illegal, and having any ** while living in Australia is special kind of retarded.

Not sure the penalties for actual C/P are any worse than they are in the U.S., U.K., Canada or anyplace else whose legal codes descend from British legal codes. The problem with Australia is they conflate victimless virtual C/P (drawn, rendered, AI or otherwise) with actual C/P made from actual victims, refusing to make a basic distinction between fantasy and reality that can be made by, ironically, a child. :poop:

Yes, it is stupid virtual is illegal but it still is. Also, from what I see here he got caught with real ** so that is no longer the matter of "stupid Australia, they arrest for drawings".

I mean the reason why he got arrested in the first place was because of the game and in pretty much every news article the main thing they reference is the game. That is why I said it's the main charge. Also in australia they don't make the distinction between fictional and real content so legally making the game is as bad or maybe even worste than just having images of real kids.

Indeed.

And there is also the possibility that the pictures of the cute 15 year old were inside some package, e.g. of amateur footage, rather than a concious download.

Actually plenty of intelligent people do stupid and/or illegal things. Like drugs.

The only thing that can be considered "stupid" is that Westy could have known he would pop up on somebody's radar at some point. And he could also have known that, once on the radar, he had to be squeaky clean.

As far as most are concerned, until the picts were mentioned, yes the game etc was the main charge, but now its different. Lawyers, like people here, can argue bout the game all they want. They can not argue bout the picts. Think of this. The picts were never mentioned until AFTER he accepted the deal

As I said: "And there is also the possibility that the pictures of the cute 15 year old were inside some package, e.g. of amateur footage, rather than a concious download."

You can argue quite a bit about an unnamed amateur 15 (or illegal 17 or legal 18) year old, as opposed to a professional 18 year old model with her birth certificate on record somewhere.

But that it's mentioned only after he accepted the deal is indeed interesting.

Keep in mind that in Australia things like underage girls in bathers sitting in a provocative way is considered child abuse material as is an over age woman who looks under age in images.
Did the article say child abuse material or child sexual abuse material. There's a different in Australia.

I actually don't remember but that is a very good point

All the articles that I have read say child abuse material
So basically non nude images, or images of women who look underage, that can be used to make him look worse to bolster their charges around the game.
There was one case I know of where a person charged with child abuse materials was charged over their own childhood photos, as in photos of themselves as a child.
If the police are looking to build a stronger case they'll add these materials in.
It also explains why bigger outlets aren't picking up the story.
If it had been child sexual abuse material he would have made the bigger Melbourne media outlets, as righteous indignation sells news.
