That kind of discrimination is common across much of Asia, not just China. Did some temp work at a Japanese owned company during college. As most Japanese companies in the US do, they had the day-to-day run by Americans, but had Japanese higher-ups. A couple of them came out to meet the temps one day: they treated white men as human, though lesser, and generally ignored the minorities and women. There was a black woman on the crew that they were outright rude to. Granted, this was in the 80s and things may have improved some since, but it always struck me how openly bigoted some folks could be - and they would rage at you if you tried to point out that they were doing it.
I don't know enough about it to know if they made that argument, it's normal to file one document with a bunch of alternative arguments, so if the judge rules against them on the lessor liability they've already made their argument that it should be dismissed for a different reason despite that. These kinds of Hail Mary alternative arguments are normal even if this one is pretty egregiously scummy, but what I think it will be interesting if they keep getting publicized and eventually companies might start thinking about how making the argument will reflect on them publicly.

That seems to be the excuse used by all companies that are carpet bombing movies with gay/les/trans characters that never existed in the original material (Marvel, DC, Tolkien, etc.). The fact that many of the productions are absolute shit because they are trying to work in an agenda rather than simply telling a good story (or at least one true to the material - Green Lantern, gay, straight or otherwise wasn't great material, for example
) isn't acknowledged by "professional" (aka, paid-off) critics or the production houses, but they are quick to blame things on "homophobes, transphobes and other bigots".
